Terms of Service

These terms govern your access to WorkOnward Reach — the dashboard, public API, SMTP service, campaigns, webhooks, analytics, and deliverability tools. We've kept them as plain as we can.

1. Acceptance

By signing up, using the API, sending email through the SMTP service, or downloading the self-hostable build, you agree to these terms. If you're using the service on behalf of a company, you confirm you're authorized to bind that company.

2. Accounts and workspaces

You're responsible for activity under your account, including API keys and SMTP credentials. Treat them like passwords — they grant access to send email under your verified domains.

A workspace is a tenant boundary. Each workspace controls its own domains, contacts, API keys, mailbox connections, and roles. Workspace owners choose who they invite and what role each member holds. Members only share resources inside the workspaces they belong to.

3. Acceptable use

You agree not to use WorkOnward Reach to send:

(a) unsolicited bulk email (spam) or content to recipients who have not consented; (b) content that infringes intellectual property, impersonates others, or defrauds recipients; (c) malware, phishing, or content designed to harm recipients or their systems; (d) content that violates applicable laws — including the CAN-SPAM Act, GDPR, CASL, and equivalent regulations in your sending jurisdiction.

We may suspend or terminate accounts that breach these rules, with or without notice depending on severity. Repeated abuse will result in permanent removal.

4. Sending requirements

You may only send from domains you've verified in your workspace. Marketing email must include a working unsubscribe link, honor unsubscribes within 10 business days (we enforce this at the platform level), and respect suppression lists.

We maintain bounce, complaint, and unsubscribe handling automatically. If a domain's complaint or bounce rate exceeds deliverability thresholds, we may temporarily pause sending from that domain to protect platform reputation. We'll always tell you when this happens and how to resolve it.

5. Platform access and external costs

WorkOnward Reach currently does not require platform payment to create an account or workspace. If payment requirements are introduced later, we will present the terms before any charge is collected.

Your workspace may still use external providers such as AWS SES, Google, or another mailbox provider. Charges from those providers are handled directly by that provider and are separate from WorkOnward Reach.

6. Suspension and termination

You can stop using the service at any time. Workspace owners remain responsible for rotating or revoking external provider credentials they connected to the workspace.

We may suspend or terminate accounts for breach of these terms, abuse, or activity that threatens the platform's reputation or legal standing. We'll provide notice and an opportunity to cure where practical.

7. Service levels

We aim for high availability on transactional sending. The status page at send.gitdate.ink/status publishes incidents in real time.

We do not guarantee inbox placement — that depends on recipient providers, your domain reputation, your content, and your list quality. We provide the tools to maximize deliverability; you provide good sending hygiene.

8. Intellectual property

You retain all rights to the content you send. We need a limited license to process and deliver that content as part of providing the service.

The WorkOnward Reach name, the WorkOnward logo, the dashboard, product workflows, and hosted service remain our property.

9. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, WorkOnward, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service.

Our aggregate liability for any claim is capped at USD 100.

10. Governing law

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in New York County, New York.

11. Changes to these terms

We may revise these terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised terms.
